Case summary

Background:
The complainant mother and defendant father separated in 2012, following which their newborn child continued to reside with the defendant. The complainant appealed against the decision of the first instance court, upheld by the Court of Appeal, to deny her custody of the child. The decision had been based solely on the fact that the child was more attached to her father.

Issue and resolution:
Custody and best interests of the child. Whether the attachment of a child to one parent can be the sole criterion to determine the best interests of the child in custody cases. The Court declared that the best interests of the child should be determined by a thorough examination of multiple factors including but not limited to the child’s attachment to a particular parent.

Court reasoning:
The Court noted that according to the Constitutional Court of Armenia, the “best interests of the child” is one of the fundamental principles of law governing relations between family members. Armenian national legislation contains a non-exhaustive list of factors to be taken into account when deciding the best interests of the child in the circumstances of the case. The Court confirmed that the minimum factors to be considered are: The child’s attachment to each parent and sibling The child’s age The child’s moral and personal characteristics The relationships between the child and each parent The possibility to create proper conditions for child’s development and upbringing (parents’ employment, financial situation, personal status, etc.) The Court held that courts should not only consider the factors set out in legislation but also evaluate any other information with which it is presented, in order to reach a conclusion based on thorough evaluation of all the evidence of the case.

«Մարդու իրավունքների և հիմնարար ազատությունների պաշտպանության մասին» եվրոպական կոնվենցիայի 8-րդ հոդվածի 1-ին կետի համաձայն՝ յուրաքանչյուր ոք ունի իր (…) ընտանեկան կյանքի (…) նկատմամբ հարգանքի իրավունք։

«Երեխայի իրավունքների մասին» կոնվենցիայի 3-րդ հոդվածի 1-ին մասի համաձայն՝ երեխաների նկատմամբ բոլոր գործողություններում, անկախ այն բանից, թե դրանք ձեռնարկվում են սոցիալական ապահովության հարցերով զբաղվող պետական կամ մասնավոր հիմնարկների, դատարանների, վարչական կամ օրենսդրական մարմինների կողմից, առաջնահերթ ուշադրություն է դարձվում երեխայի լավագույն շահերին։ Նույն հոդվածի 2-րդ մասի համաձայն՝ մասնակից պետությունները պարտավորվում են երեխային ապահովել նրա բարեկեցության համար անհրաժեշտ պաշտպանությամբ և հոգատարությամբ՝ ուշադրության առնելով նրա ծնողների (…) իրավունքներն ու պարտականությունները, և այդ նպատակով ձեռնարկում են օրենսդրական ու վարչական բոլոր համապատասխան միջոցները։

«Երեխայի իրավունքների մասին» կոնվենցիայի 5-րդ հոդվածի համաձայն՝ մասնակից պետությունները հարգում են ծնողների (…) պատասխանատվությունը, իրավունքները և պարտականությունները՝ երեխայի զարգացող ունակություններին համապատասխան ուղղություն տալու երեխային՝ նրա կողմից նույն կոնվենցիայով ճանաչված իրավունքներն իրականացնելիս:

«Երեխայի իրավունքների մասին» կոնվենցիայի 7-րդ հոդվածի 1-ին մասի համաձայն՝ երեխան (…) ծննդյան պահից ձեռք է բերում, (…) որքան դա հնարավոր է, իր ծնողներին ճանաչելու և նրանց խնամքի իրավունք։

«Երեխայի իրավունքների մասին» կոնվենցիայի 18-րդ հոդվածի 1-ին մասի համաձայն՝ մասնակից պետությունները գործադրում են բոլոր հնարավոր ջանքերը՝ երեխայի դաստիարակության և զարգացման գործում երկու ծնողների ընդհանուր պատասխանատվության սկզբունքի ճանաչումն ապահովելու համար: Ծնողները (…) երեխայի դաստիարակության ու զարգացման համար կրում են հիմնական պատասխանատվություն: Երեխայի լավագույն շահերը նրանց հիմնական հոգածության առարկան են:

«Մարդու իրավունքների և հիմնարար ազատությունների պաշտպանության մասին» եվրոպական կոնվենցիայի 8-րդ հոդվածի տեսանկյունից անդրադառնալով «երեխայի լավագույն շահ» հասկացությանը՝ Մարդու իրավունքների եվրոպական դատարանն (այսուհետ՝ ՄԻԵԴ) արտահայտել է այն իրավական դիրքորոշումը, որ պետական իրավասու մարմինների, այդ թվում նաև՝ դատարանների կողմից երեխայի խնամքի և դաստիարակության վերաբերյալ վեճերի լուծման համար վճռորոշ նշանակություն ունեն երեխայի լավագույն շահերը, որոնց գնահատումը կախված է կոնկրետ գործի հանգամանքներից (տե՛ս, «Ս.»-ն ընդդեմ Ֆինլանդիայի գործով ՄԻԵԴ-ի 09.05.2006 թվականի վճիռը, 52-րդ և 53-րդ կետեր)

>>: According to Article 8 paragraph 1 of the European Convention on Human Rights and Fundamental Freedoms, everyone has the right to respect for his family life.

According to Article 3 paragraph 1 of the Convention on the Rights of the Child, in all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration. Under paragraph 2 of the same article, States Parties undertake to ensure the child such protection and care as is necessary for his or her well-being, taking into account the rights and duties of his or her parents (…) and, to this end, shall take all appropriate legislative and administrative measures.

According to Article 5 of the Convention on the Rights of the Child, States Parties shall respect the responsibilities, rights and duties of parents (…) to provide, in a manner consistent with the evolving capacities of the child, appropriate direction and guidance in the exercise by the child of the rights recognized in the present Convention.

According to Article 7 of the Convention on the Rights of the Child, a child (…) shall have the right from birth (…) as far as possible, the right to know and be cared for by his or her parents.

According to Article 18 paragraph 1 of the Convention on the Rights of the Child, States Parties shall use their best efforts to ensure recognition of the principle that both parents have common responsibilities for the upbringing and development of the child. Parents (…) have the primary responsibility for the upbringing and development of the child. The best interests of the child will be their basic concern.

Regarding the aspects of Article 8 of the European Convention on Human Rights and Fundamental Freedoms which relate to the “best interests of the child”, the European Court of Human Rights (ECtHR) has expressed the legal position that the assessments of the child’s best interests made by relevant public authorities, including courts, crucial for solving disputes concerning the child’s care and upbringing of the child’s best interests, will depend on the particular circumstances of the case (see C v. Finland, judgment of the ECtHR, 09.05.2006)

CRIN comments:
CRIN believes that this decision is consistent with the CRC. While Article 12 of the Convention requires that the views of the child are given weight in all matters affecting them, determining the child’s best interests is a highly subjective, circumstantial and complex task, requiring the consideration of a wealth of factors.
